However, adult gerinas failed to prove that it was she who decorates the wrapper. The girl from the cover in the year "Red October" decided that an original wrapper with a branded portrait was needed for the new chocolate of Alenka.

At first, the chocolate was produced with different images. There was an idea to use Vasnetsova to design Alyonushka, but the artist’s work bypassed the portrait of Elena Gerinas. Her father, photojournalist Alexander Gerinas, sent a photo of eight -month Lena to the contest for chocolate for chocolate. Prior to this, a picture of a girl in a handkerchief appeared at exhibitions, in the publication "Soviet photo", and then decorated the cover of the first issue of the magazine "Health".

A drawn copy of the picture saw the light of the year. However, the artist N. Maslov, transferring the portrait to the wrapper, changed his eyes, making them blue, extended the oval of his face, and increased his upper lip. As the media wrote, the heiress of the photographer demanded that the defendant pay the fee for using the picture. According to the plaintiff, the factory did not conclude an agreement with their family, therefore it has no exclusive right to cover the chocolate.

Gerinas estimated the author's reward at almost five million rubles. Dozens of photographs of the little Helen were considered, the forensic expert of the Ministry of Justice Zotov counted 18 common signs. However, the expert artist came to the conclusion that the illustration is not at all a little Elena, but a collective image, an independent work. Based on this, the court decided: to refuse the claim.

A special knot is all “material evidence” - the January issue of the “Health” magazine for a year, the old photos - Elena Alexandrovna carefully protects that the opposite side could not use them in her interests. In the history of Alenka there are a lot of gaps - for example, the exact name of the artist who was redrawn with the photo: N. Maslov is not alive, and there is no one to ask.

Here we are dealing with civilian casoustics. In Russia, the copyrights of the manufacturer of the image are protected, not the person whose face is presented in the image. The Civil Code of the Russian Federation does not clearly spell out the right to its own person, no matter how and whatever it is portrayed. Therefore, the trial of Alenka Alenka lost. The factory artist only retired a photo of the girl - and she became a different work.

The chocolate expert has passed since then for more than ten years. To prove that on the wrapper was her photo, Elena Gerinas no longer tried. In addition to her, other applicants were on the title of Alenka. For example, a resident of Bryansk, who supposedly not only adorned a chocolate bar, but was also on the cover of the magazine "Health". Alenka was also found in the Kuban: the woman claimed that in the year the metropolitan photographer, who chose her, came to their kindergarten.

But for the majority, it is Elena Gerinas who is the prototype of the girl from the packaging of her beloved delicacy: no matter what the artist “gathered” there, the facial expression on the Alenka’s chocolate “Alenka” is exactly the same as the gerinas, captured by the photographer’s father several tens of years ago. Elena did not follow in the footsteps of her father - she is a specialist in the field of pharmacology.

Now a woman lives in Khimki near Moscow with her husband and two children. It can sometimes be seen on the TV screen - for example, as an expert on chocolate "Alenka", which now produces not only "Red October", but also other confectionery factories.
